17.06.2021 TGA Law Office participates in the 8th Congress of Banking Law organized by the Association of Polish Banks

On June 17, 2021, the 8th Congress of Banking Law, organized by the Association of Polish Banks took place. This year’s edition was devoted to three topics, one of which focused on the current directions of restructuring from the perspective of the Polish banking sector. The Partner of the TGA Law office and an insolvency law expert, advocate Bartosz Groele, gave his lecture on this topic. His presentation answered the following question: “Is the establishment of a mortgage still a certain way of securing a claim? – the current direction of the case law on the conflict of powers between a Paulian creditor and a mortgage creditor”. The issues discussed are an important part of the Law Office’s professional practice, in which advocate Bartosz Groele and advocate Kamil Strus are currently particularly involved.

Outcome of the 18th edition of the Rzeczpospolita Daily 2020 ranking of law offices.

On 10 June 2020 an annual ranking of law offices was published by the Rzeczpospolita Daily. For the last year, due to the Covid-19 pandemic, the classification was not announced in the “recommendations” categories to maintain the continuity of the ranking; however, this year the ranking was carried out and the results were secured. This year the chapters did not select the winners in each category, but the number of indications of the law office itself was decisive. We are delighted to inform that the TGA Law office has been recognised in the area of our specialization: restructuring and bankruptcy law. TGA was awarded the status of one of the four recommended law offices, along with the best ones on the market, and among the recommended lawyers was the Partner of our Law Office and a long-time insolvency law expert, advocate Bartosz Groele. 10.06.2021 advocate Bartosz Groele was a speaker at a scientific seminar of the Department of Commercial Law of the University of Gdańsk and the Fahrenheit University Association.

Today, June 10, 2021, Partner of the Law Office, advocate Bartosz Groele participated in a scientific seminar devoted to current problems of bankruptcy and restructuring law, organized by the Department of Commercial Law of the University of Gdańsk and the Fahrenheit University Association. The topic of the lecture was: “Regulating capital groups in restructuring and bankruptcy law – are changes needed?”. The seminar was devoted to issues related to the implementation of Directive 2019/1023 on preventive restructuring frameworks, on discharge of debt and disqualifications, and on measures to increase the efficiency of procedures concerning restructuring, insolvency and discharge of debt. The seminar also concerned the assessment of simplified restructuring proceedings which were introduced by Shield 4.0, which also functions as a pilot solution for the measures provided for in the Directive.

Approval of the arrangement in the PPU procedure for the amount of receivables of PLN 12 million

We are pleased to announce another success of the Law Office. On 24 May 2021 the District Court for the Capital City of Warsaw in Warsaw approved an arrangement in accelerated arrangement proceedings under a partial arrangement for a leading automotive industry company. The sum of the liabilities covered by the arrangement is approximately PLN 8 million and the arrangement was supported by 100% of the creditors. The case was handled by the team of the Law Office under the supervision of advocate Bartosz Groele, advocate Bartosz Magnowski and attorney- at-law Agnieszka Kuciak.

5-7 May 2021, New York, 58th session of the Working Group V UNICITRAL (Insolvency Law)

On 5-7 May 2021 a session of V Working Group of Insolvency Law (UNICITRAL) will take place. Once again, the Partner of the Law Office, advocate Bartosz Groele will be among the delegates from the Ministry of Development, Labor and Technology. Although it is New York that will host the event this year, due to the pandemic the deliberations will be held predominantly online. This session will be operated from Vienna where delegates will be able to attend in person. The work on the draft text concerning the simplification of the bankruptcy system will be continued, with the aim of presenting the final draft to the Commission. 20.04.2021 Success of the Law Office in the proceedings concerning the prohibition to operate a business

We are pleased to announce that on 20 April 2021 the District Court for the Capital City of Warsaw in Warsaw, after more than two years of proceedings regarding the prohibition to operate business activity pursuant to Article 373 of Bankruptcy Law, decided to dismiss the application filed against our client, who was a former member of the management board of a large listed company which was part of a capital group providing comprehensive operator services within their fiber-optic infrastructure throughout the country.
It should be noted that he is the second member of the management board of this company to instruct in a similar case advocate Bartosz Groele and advocate Kamil Strus. The previous case has already been legally decided in favour of our client. We are very pleased that we have had the opportunity to effectively secure our clients’ interests in advanced economic proceedings

14.04.2021 approval of the arrangement under accelerated arrangement proceedings for PLN 12 million worth of claims

We are pleased to announce that on 14 April 2021 the District Court for Kraków Śródmieście, VIII Commercial Division, approved the arrangement in the accelerated arrangement proceedings of our client operating in the meat industry. The proceedings were handled by the team of the Law Office, with advocate Barosz Groele and advocate Bartosz Magnowski at the helm. The sum of the claims covered by the arrangement is over PLN 12 million. It is worth emphasizing that the required 90% of support for the agreement was obtained thanks to the professionally conducted negotiations.
