We are pleased to announce that on December 16, 2021, the District Court for the Capital City of Warsaw in Warsaw, 18th Commercial Division for bankruptcy and restructuring issues, issued a decision in the accelerated arrangement proceedings of CAD/CAM SOLUTION Sp. z o.o. in restructuring regarding the approval of the second of the partial agreements – towards the company’s contractors. Importantly, the court decision allowed to close a precedent case in which two accelerated restructuring proceedings were opened with partial agreements addressed to financial institutions and the client’s contractors. We are pleased to announce that on December 7 this year, the draft act on the modernization and improvement of the efficiency of hospitality was entered into the list of legislative and program works of the Council of Ministers, in which the partner of the TGA law firm, advocate @Bartosz Groele, actively participated. The purpose of the draft act is to modernize and improve the efficiency of operations as well as to improve the economic and financial situation of hospital entities, as well as to support their development and optimization of their operations. We are honoured to inform that Partner of the TGA Law Firm, advocate Bartosz Groele, as an expert in insolvency law, once again is among the delegates to the session of Working Group V UNCITRAL (Insolvency Law), which will be held from 13 to 17 December this year. The host of the 59th edition of this event will be, as in the previous year, Vienna. During the December session, the final draft legislative guide on insolvency law for micro and small enterprises will be presented. We are pleased to announce that on October 15 this year, the District Court for the Capital City of Warsaw agreed with the position of the Law Firm and issued a decision on the adoption of a partial agreement for one of the companies operating in an international level in the CADCAM services industry. Quite interestingly, it was one of the few restructuring proceedings where TGA aimed at opening, simultaneously, two partial arrangements addressed at financial institutions (banks and leasing providers) and the client’s contractors. The aim of the two partial arrangements was to avoid the risk of production stoppage, while at the same time to restructure the obligations essential for the company’s survival. The following persons constibuted to the success in this case on behalf of the Law Firm: TGA partner advocate Bartosz Groele and attorney-at-law Agnieszka Kuciak. On behalf of the TGA Law Firm, we would also like to thank advocate @Bartosz Magnowski for his commitment and excellent cooperation on this project. We are pleased to announce that on October 7 this year, there was a scientific conference organized by the Department of Commercial Law of the Faculty of Law and Administration of the University of Gdańsk and co-organized by the International Restructuring Research Association, whose board member is TGA’s partner, advocate Bartosz Groele. The subject of the conference was the Report on the research on the implementation of the provisions of Directive (EU) 2019/1023 of the European Parliament and of the Council in the context of implementing the interests of banks.
